The Virtual Currency Regulation Review is an international publication describing the legal and regulatory status of virtual currencies (also called cryptocurrencies) and future legal developments in the area. The publication relates to a number of activities with respect to virtual currencies from a regulatory perspective, including trading, exchanging, mining and issuing of virtual currencies. Furthermore, certain aspects of virtual currencies are analysed from a private law perspective as well as a criminal law perspective.

Partner Niclas Rockborn and senior associate Rikard Sundstedt, both active primarily within Gernandt and Danielsson’s specialist and financial services group, are authors of the chapter in the publication regarding Sweden. In this year’s edition, considerable focus is dedicated to recently proposed EU legislation in the form of a Regulation on Markets in Crypto-assets (the so-called MiCA-regulation) and a Regulation on a pilot regime for market infrastructures based on distributed ledger technology, which are both part of the European Commission’s Digital Finance legislative package. If the legislative initiative is enacted, it would constitute a paradigm shift in the regulation of virtual currencies, bringing them from being largely unregulated to being in scope of rigorous regulation covering a wide range of aspects and activities.
